Terms of Service

These terms are a contract between you and Coding Friend, LLC, a Maryland limited liability company ("we", "us"), which runs Email the Hiring Manager at emailthehiringmanager.com (the "Service"). By creating an account, running a lookup or buying credits, you agree to them. If you don't agree, don't use the Service.

1. What the Service does

You give us a link to a job posting. We research publicly available professional information to identify people who are likely connected to that hiring: the hiring manager, people in the same department, and recruiters at the employer. We show what we found, how sure we are, and a suggested note you can send yourself.

Every result is labeled:

  • Hiring manager: the person's own public professional information matches the team or the "reports to" line in the job ad.
  • May own this hire: a real person currently at the employer, in this line of work and senior to the role, whom we could not confirm as the person running this team. They may own the hire, or be able to forward your note to whoever does.
  • Recruiter for this job: a recruiter or talent-acquisition person currently at the employer whose work matches this kind of role.
  • Can forward your note: HR or a recruiter on a different desk at the employer.

Email addresses are labeled too: verified means the employer's mail server confirmed the mailbox exists; best guess means it follows the employer's known email format but could not be confirmed.

2. What we don't promise

The Service is research, not a guarantee. We do not promise that anyone will read or reply to your message, that you will get an interview or a job, or that any person listed is the final decision-maker for the role. People change jobs and titles, and company email systems change. Public information can be out of date even when we check it carefully.

We don't contact anyone for you, and we are not a staffing agency, recruiter or employer. Nothing on the Service is career, legal or employment advice.

3. Accounts

You must be at least 18 years old and give a real email address you control. Keep access to your email secure, because sign-in links go there. One person, one account. You're responsible for activity on your account.

4. Credits, prices and payment

  • One credit = one lookup for one job posting. New accounts include free credits, as shown at sign-up.
  • When a lookup uses a credit: when the result shows at least one confirmed hiring manager, a person who may own this hire, or a recruiter confirmed at the employer for this kind of role.
  • When a lookup is free (the credit goes back automatically): when the job is posted by a staffing agency, when the ad hides the employer, when the link can't be read, or when we can't show you any proven current contact.
  • Credits don't expire, have no cash value, and can't be transferred or resold.
  • Payments are processed by Stripe. We never see or store your full card number. Your card statement will show CODINGFRND* HIRINGMGR.
  • Prices are shown before you pay and may change for future purchases. Prices don't include any taxes that may apply.

5. Result reviews and refunds

If you believe a result is wrong, use "Report a problem" on the result page within 14 days of the lookup. We review every report against our records and public information, usually within 3 business days.

We return the credit when we confirm that:

  • a person shown as a hiring manager or recruiter had already left the employer before the date of your lookup;
  • a person shown never worked at that employer, or is a different person with the same name; or
  • a verified email address hard-bounced (your bounce message helps us confirm this), or every address shown for every person on the result bounced.

We don't return credits for:

  • no reply, a slow reply or a "no" from anyone you contacted;
  • a May own this hire person who works at the employer in that line of work but turns out not to be the final decision-maker. That label already tells you we couldn't confirm it;
  • disagreement about who "should" own the hire when the people shown match their labels;
  • a best guess email that bounced when another shown address for the same lookup did not;
  • a job that was filled, paused or reposted after your lookup; or
  • reports made more than 14 days after the lookup.

We decide each report on the evidence, and our decision on a credit is final. Reports that misstate facts, repeated reports on results that match their labels, or attempts to collect credits for results you used may lead to suspension of your account.

Money-back on purchases: you can get a full cash refund of a credit pack within 14 days of buying it if you haven't used any credits from that pack. After that, or once you've used credits from the pack, credit packs are not refundable in cash. Credits returned under this section go back to your account, not to your card. Nothing here limits any refund right you have under law that can't be waived.

6. How you may use the results

The Service is for your own job search. You agree that you will:

  • contact people only about a job you're genuinely applying for, with short, honest, professional messages, and no more than one follow-up unless they reply;
  • follow the laws that apply to your messages, including anti-spam laws, and stop contacting anyone who asks you to;
  • not sell, publish, share or reuse the results, or add the people in them to mailing lists, databases or marketing;
  • not harass, threaten, impersonate anyone or misrepresent yourself;
  • not scrape, copy or run automated queries against the Service, resell it, or try to get around credit limits or security; and
  • not use the Service for recruiting, sales, debt collection, investigations or any purpose other than your own application.

You are responsible for every message you send. We may suspend or close accounts that break these rules, without refund of credits used in breaking them.

7. The people in our results

The people we list are professionals whose work information is publicly available. We treat that information with care and explain how in our Privacy Policy. Anyone who doesn't want to appear in results can ask us to remove them at hello@emailthehiringmanager.com, and we will.

8. Our content

The Service, its design, text, guides and the suggested notes are ours or our licensors'. You may use suggested notes and results for your own job search messages. You may not copy the Service or its content for any other purpose.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS ARE COMPLETE, CURRENT OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.

10. Limit of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST EARNINGS, LOST JOB OPPORTUNITIES, LOST PROFITS, LOST DATA OR DAMAGE TO REPUTATION, ARISING FROM OR RELATED TO THE SERVICE, ANY RESULT, OR ANY MESSAGE YOU SEND OR RECEIVE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $25 IF YOU PAID NOTHING. THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME STATES DON'T ALLOW SOME OF THESE LIMITS; THEY APPLY TO YOU ONLY AS FAR AS YOUR STATE ALLOWS.

11. Your responsibility to us

You will defend, indemnify and hold harmless Coding Friend, LLC and its members, managers, contractors and service providers from any claim, demand, loss, fine or cost (including reasonable attorneys' fees) arising from: messages you send to anyone found through the Service; your use or misuse of results; your breaking these terms or any law; or any claim by a person you contacted. We may take control of the defense of any such claim at your expense, and you'll cooperate.

12. Disputes: binding individual arbitration

Please read this section carefully. It affects your legal rights.

  • Talk to us first. Before any claim, email hello@emailthehiringmanager.com describing it and the relief you want, and give us 60 days to resolve it.
  • Arbitration. Any dispute arising from or related to these terms or the Service that we can't resolve informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, held online or by phone where possible, or otherwise in Maryland. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.
  • Exceptions. Either side may bring an individual claim in small-claims court if it qualifies, and either side may ask a court to stop infringement or misuse of intellectual property or the Service.
  • No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims or award class-wide relief. If this waiver is found unenforceable for a claim, that claim (and only that claim) goes to court, and the rest of this section still applies.
  • Jury waiver. To the extent any claim goes to court, you and we waive the right to a jury trial.
  • Opt-out. You can opt out of arbitration within 30 days of first accepting these terms by emailing us with your name, account email and "I opt out of arbitration".
  • Time limit. Any claim must be filed within one year after it arose, or it's permanently barred, to the extent the law allows.

Maryland law governs these terms, without regard to conflict-of-law rules. Any court proceeding allowed by this section will be in the state or federal courts located in Maryland, and you consent to their jurisdiction.

13. Changes, suspension and general terms

We may change these terms, the Service, its features or its prices at any time. We'll post the new date at the top, and for material changes we'll email account holders before they take effect. Continuing to use the Service after that means you accept the changes. We may refuse service, limit lookups, or suspend or close any account at our discretion, including for suspected abuse, fraud or breaking these terms. If we close an account without cause, we'll refund unused purchased credits at the price paid.

These terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our not enforcing a part isn't a waiver. You may not transfer these terms; we may transfer them with the business. There are no third-party beneficiaries. We're not responsible for delays or failures caused by events beyond our reasonable control, including outages of the services we rely on. Sections 2 and 5–13 survive the end of your account.
